Broxtowe News Update & Information – February 2020 edition

Hi all

Welcome to my second newsletter of 2020.  A special greeting to all those who have joined over the past month or so.

It seems (well to me anyway) an absolute eternity since my last newsletter which I sent out on 9 January.   I went on holiday for two weeks last month, and during this time I was receiving multiple messages on local issues such as flooding in Kimberley near Kettlebrook Lodge, planning applications, and the widespread disquiet regarding tree felling on the former brewery site amongst other matters.

This newsletter is therefore probably longer than some of my most recent ones as there is a lot of information to relay following the amount of questions I’ve been asked on the above and other issues too.  So please bear with me.  

I’ve been tagged in various social media (Facebook) posts during the past few weeks, in addition to emails, ‘phone calls and other messages.  I’m going to endeavour to cover in this one newsletter as comprehensive an update as I can.  However if I have missed anything out – I’m sorry – please do come back to me!  Additionally I started a new job on 3 February (see item 10 below) – so it’s fair to see it’s been pretty full on during February.  

There are other issues I’m working on in Kimberley – particularly concerning highways matters – I’m not going to go into specific detail now, but will cover them in depth in subsequent newsletters later this year.

 Broxtowe News Update & Information – February 2020 edition 
1)  Petition to Broxtowe Borough Council regarding Ruilsip Close and Bassett Close car park
At the Full Council meeting at Broxtowe on 18 December 2019 I presented a petition to Broxtowe Borough Council on behalf of local residents, who are unhappy with the state of the adjacent car park.  Resurfacing has taken place elsewhere in this vicinity, but thus far this particular piece of land in question has been excluded.
As soon as I get an update with progress I will let you know.
2)    Severe disruption in Kimberley traffic flow in the run up to Christmas
I reported in January’s newsletter: – how i had met on
Monday 30 December 2019 at Sainsbury’s cafe in Kimberley two representatives of Western Power, after the recent severe traffic problems before Christmas on Main Street. They explained in details their roles and responsibility, that of their contractors Gallagher, and also the notification they had provided to the County Council.
Relating to this issue and in various subsequent conversations, I have received comments from local residents on how traffic flow could be possibly improved generally, when trying to exit Swingate.  One of the ideas I have received is to encourage the County Council to reverse the current One Way system on High Street (thereby allowing traffic to exit Swingate without being forced to come down Greens Lane past Sainsbury’s).
I am planning to write shortly to local residents in the immediate vicinity who would be affected by such a change, before putting any concrete proposals to the County Council.

3)   Flooding in Kimberley – Eastwood Road – water draining onto the highway – causing particular problems near Kettlebrook Lodge and the Broxtowe council depot
I have received much correspondence and much also concern about this matter.
I’m sure many of you in Kimberley will have seen the problems on a first hand basis.  I missed some of the worst occurrences whilst I was away in January.
I have arranged a meeting between several bodies including Severn Trent, Broxtowe Borough Council, and various community leaders who use Kettlebrook Lodge for Wednesday 11 March so we can get a joined up long-term solutions to the problems here.

4)  Free bulky waste collections in March for Broxtowe residents
Free bulky waste weeks will be taking place during next month for Broxtowe residents – please see: for dates.  Please note that in March for the northern part of Broxtowe – the locations will be Nuthall, Kimberley & Brinsley respectively.

5)   Former brewery site Kimberley
It’s undoubtedly fair to say that the shedding of the trees adjacent to Hardy Street, Nine Corners and Eastwood Road has caused much grief to many local residents, and I have received a stack of complaints and questions about this and generally about the former brewery site development during the past six weeks.
These are the questions (and subsequent answers) to the those raised: 
a) Have the owners of the brewery site paid proper rates on the empty buildings? – Answer: The Brewery was taken over by Greene King Brewing & Retailing Limited on 5 September 2006 and remained a fully operational concern, paying business rates, until it ceased operations until 24 April 2008.  From 25 April 2008 until 1 February 2018, when it was sold for housing development, no money was paid in business rates.  The property was put on a ‘Listed Exemption’ and no rates were payable. 
b) What are the S106 (developer contributions) going towards locally?  Answer: The only S106 monies from the development are those for affordable housing (£279,857). The S106 Agreement requires that these are paid prior to practical completion or occupation of 10 dwellings within ‘Area 1’ which forms part of the ‘woodlands’ area.
c)  Concerns were raised on the reports that were necessary concerning Arboricultural Assessment, Bats Amphibians, Breeding birds etc.  Residents in particular have commented on whether the reports were actually undertaken by the council and what the public access to them is?  Answer: The reports were submitted as part of the original planning application 13/00570/FUL and proposed mitigation measures which need to be adhered to. This includes bat and bird boxes. The Reserved Matters application only related to design, layout, scale and landscaping rather than the principle of the development.
d) What is happening with the Maltings and tower buildings?  Answer: The Maltings are being converted into 18 apartments (17/00825/FUL). The tower will also be converted into residential use (13/00570/FUL).
e)  What is the situation regarding the new houses that are sitting on a sheer wall of soil, and why is there no retainer wall?  Answer: The completed houses were subject to building control checks throughout the development. There is a drainage scheme for the houses on the former woodland area which will deal with existing or future drainage issues arising from the development.
f) A number of people have asked for dates of Planning Committees at Broxtowe that have sat over the past few years that have made key decisions pertinent to how the developments are taking shape now – please see immediately below:
There were two planning committees – 8 October 2014 and 7 October 2015 respectively where original decisions were made.  If anyone wants copies of the minutes please let me know.
Further points were raised about which decisions have been delegated to officers and which have gone to committee?
·       13/00570/FUL & 13/00571/LBC – ‘The original consents’ – this was a hybrid application, part ‘full’ (the brewery yard) and part outline (the woodland and former warehouse yard). All documents submitted can be found on the council’s website.
·       This application was determined by planning committee on 8 October 2014.  It was taken back to Committee on 7th October 2015 with the only alterations being to the wording/phasing of the conditions.
·       16/00333/REM – Reserved matters approval for phase 1 (of planning permission 13/00570/FUL) area of residential development to construct 25 dwellings including appearance, layout and landscaping. The application was taken to planning committee on 9th November 2016. It was determined to grant planning permission subject to minor amendments to the design and materials of some of the proposed dwellings.
·       17/00022/MMA – Minor material amendment of planning permission 16/00333/REM to allow for alterations to the design of plots 1-25. This was a delegated decision 13.3.17.
·       17/00118/ROC – Removal of condition 11 of planning permission ref: 13/00570/FUL. This was a delegated decision 12.01.18
·       17/00699/FUL (and corresponding listed building consent) – External alterations and conversion of Kiln Stores to two dwellings and associated parking. Delegated decision 28.1.19.
·       17/00700/FUL – Change of use from Kilns to create 8 duplex apartments and ancillary parking (and corresponding listed building consent). Delegated decision 28.1.19.
·       17/00701/FUL – Construct 14 four storey town houses. Committee decision. 21.3.18
·       17/00771/FUL – Revisions to the design of plots 9 and 10 approved under reference 17/00022/MMA and the construction of an additional dwelling to form a terrace. Delegated decision 23.3.18
·       17/00825/FUL (and corresponding listed building consent) – Change of use from Maltings building to 18 apartments with parking. Committee decision 21.03.2018
·       18/00857/REM – Construct 55 dwellings (approval of reserved matters relating to planning reference 13/00570/FUL). Delegated decision  28.11.19

Posts can be at times highly charged – generating more heat than light.  
Moving forward I am keen to take fully onboard the ongoing concerns that people have for the the coming months and years and into the forseeable future. I know some are concerned for example about the availability of school places, the immediate impact on the fragile roads and road systems in and around Kimberley – especially the problems in and around Hardy Street, Maws Lane & Cliff Boulevard for example.
I am happy to arrange a public meeting if you feel this will be both productive and constructive – I can invite Broxtowe Planners, Fairgroves, County Council – and other relevant bodies as appropriate.

6)   Penalty charges for charging in The Precinct, Kimberley

The arrangements for parking in The Precinct, Kimberley have changed, and now there is a limited free parking for a set amount of time.  I have received some complaints about people being charged excessive fees when they have overstayed  the limit – even when it is only for a matter of minutes.  If you have experienced any problems please let me know.


7)   Publicly available WI-FI in Kimberley

This is now set to be installed in the town centre next month after consultations with the various partners.

8)   Tram extension from Phoenix Park through Kimberley & Eastwood


Many of you will have heard the news that the Hs2 High Speed Rail link is now planned to go ahead.  The Government have confirmed this.   There is a major impact in Broxtowe – with the Hs2 station at Toton, with manifest opportunities for jobs, investment, growth and connectivity in the north of the borough.

I will be doing whatever I can working with colleagues from various bodies and from different political parties and local authorities to expedite the tram extension plans out from Phoenix Park, and to make sure that we are connected with Hs2 at Toton.

We have an internal meeting at Broxtowe Borough Council next week to look specifically at this, and I hope to report back in next month’s newsletter as to what timescales we might be looking at going forward.  An in depth and comprehensive Feasbility Study is due to take place later this year to help with the planning of this project – including other public transport options along the A610 corridor.

9)  Return of the Farmers Market in Kimberley?

I reported a while back that interest was being shown again in reinstating a monthly Farmers Market taking place in Kimberley.  I’ve been told that a local market operator is keen to explore some options, and I am due to meet with them next month.

I’ve also received interest from local traders who are willing to participate at the market with a stall.

As soon as there is any more information I will let you know.

10)   My new full-time job

Some of you will be aware that my full time job for a number of years has been working for a Member of Parliament – see for full details.  For seven years I worked for Gavin Shuker in Luton South and when he lost his seat at the General Election in December last year – I duly lost my job.

I was duly asked earlier this year by the new MP for Ashfield Lee Anderson to join his staff team – working for him in the constituency office helping with casework (based in Sutton in Ashfield).  I have been working here since 3 February this year.

My position as in Independent Cllr in Kimberley remains unchanged.

I am not a member of any political party.

Golden goose classes

Are small friendly groups meeting for textile lessons in my home on the Gilthill, Kimberley.  Classes are limited to 5 students in well equipped workroom. Gerry Hargreaves has a background of electrical installation and maintenance followed by considerable experience of energy monitoring providing technical support to the marketing division of East Midlands Electricity.

Projects throughout the UKhave included energy monitoring and data/billing analysis to assist companies to improve efficient use of energy. This has included disputes with electricity suppliers and distributors and site surveys, installation of temporary monitoring equipment and recommendations to install suitable power factor correction equipment. Site surveys for the installation of a M&T at major sites, have been undertaken and with the recent advances in remote monitoring technologies surveys and installation of GSM smart meters have been undertaken at distribution centres of a leading logistics company. A request by a leading UKenergy supplier has resulted in the installation of remote data collection technology, including planning and installation of remote data logging equipment to monitor and analyse usage data from geothermal sites within theUK. This work is ongoing in the development of renewable energy and low carbon technology.

Site visits and travel are significant reduced with the application of t-mac technology.
